Van Hive UK – Terms & Conditions of Sale
1. Nature of Sale
All vehicles sold by Van Hive UK are supplied strictly on a trade-sale basis, unless expressly agreed otherwise in writing.
By purchasing a vehicle, the buyer confirms that they are acting in the course of a trade, profession, or business and not as a private consumer.
This classification means that the Consumer Rights Act 2015 and all related consumer protection legislation do not apply to the transaction.
Trade sales are final and made without statutory rights to return, reject, or claim post-sale repairs or compensation under consumer law.
2. Application of Terms
These Terms & Conditions apply to all vehicle sales conducted by Van Hive UK, whether arranged in person, over the phone, online through our website, or via third-party advertising platforms including eBay, Auto Trader, Facebook Marketplace, and similar services.
By enquiring, placing a deposit, or completing a purchase through any of these channels, the buyer acknowledges and accepts these Terms & Conditions in full.
No variation, verbal assurance, or side agreement shall override these terms unless expressly agreed in writing by a director of Van Hive UK.
3. Vehicle Inspection and Acceptance
All vehicles are available for inspection and test drive by appointment prior to purchase. Buyers are encouraged to satisfy themselves as to the vehicle’s mechanical condition, history, and suitability before finalising the sale.
By completing the transaction, the buyer confirms that they have either inspected the vehicle or chosen not to, and that they are satisfied with its condition and specification.
Vehicles are sold as used trade vehicles, and reasonable wear and tear consistent with age, mileage, and previous usage should be expected.
Once payment has been made and the vehicle collected or delivered, the sale is deemed complete and no returns, refunds, or cancellations will be accepted.
4. Warranties and Liability
Unless expressly stated in writing, no warranty, guarantee, or assurance is given or implied by Van Hive UK.
All vehicles are sold as seen and tested, without warranty as to condition, reliability, fitness for purpose, or merchantable quality.
Van Hive UK will not be held liable for:
-
Mechanical, electrical, or cosmetic faults arising after collection or delivery
-
Costs, inconvenience, or losses caused by breakdown, repair, or defect
-
Any work, parts, or diagnostics undertaken by third parties without written authorisation
Buyers are responsible for arranging their own warranties, roadside assistance, and insurance cover following purchase.
5. Authorisation of Repairs
No diagnostic, repair, or remedial work should be undertaken without prior written approval from Van Hive UK.
Any work carried out independently, or without our express written authorisation, will be deemed unauthorised and entirely at the buyer’s own expense.
Van Hive UK will not reimburse, contribute to, or be held responsible for costs arising from such unauthorised work.
6. Assistance and Quotations
If an issue is reported after purchase, Van Hive UK may — at its discretion and as part of its professional service — assist in obtaining independent repair quotations or technical advice.
This assistance is provided as part of our specialism and does not constitute acceptance of liability or authorisation for any work to proceed.
The buyer must await written confirmation before instructing any repair, otherwise full responsibility for associated costs remains with them.
7. Returns and Cancellations
Vehicles sold under trade-sale terms are non-returnable and non-refundable once collected or delivered.
Van Hive UK is under no obligation to accept returns or cancellations for any reason, including mechanical or cosmetic issues arising after purchase.
Any exception to this policy is made entirely at the discretion of Van Hive UK, and only after inspection of the vehicle at our premises.
8. Descriptions and Advertising
All vehicle descriptions, photographs, mileage figures, and specifications are provided in good faith and are intended as a guide only.
Buyers are responsible for verifying all details before purchase.
No representation, statement, or advertisement made by Van Hive UK forms a contractual term or warranty.
9. Payment, Deposits, and Ownership
Full cleared payment is required before any vehicle is released for collection or delivery.
Ownership, title, and responsibility for the vehicle pass to the buyer once full payment has been received.
Deposits are non-refundable unless otherwise agreed in writing.
In cases where delivery is arranged, risk transfers to the buyer upon delivery. Van Hive UK accepts no liability for transport delays, third-party carrier issues, or unforeseen logistical disruptions.
10. Documentation and V5C Registration
Van Hive UK will process the change of ownership with DVLA following completion of sale.
While every effort is made to ensure prompt documentation, responsibility for tracking or replacing V5C documents lies with the buyer once transfer has been submitted.
11. Jurisdiction and Governing Law
All transactions with Van Hive UK are governed by the laws of England and Wales, regardless of the buyer’s location.
Any disputes shall be resolved exclusively under the jurisdiction of the courts of England and Wales.
12. Entire Agreement
These Terms & Conditions represent the entire agreement between the buyer and Van Hive UK.
No previous correspondence, statement, or understanding — written or verbal — shall override the terms contained herein.
Important Notice
By placing a deposit, making payment, or purchasing a vehicle from Van Hive UK, the buyer confirms they have read, understood, and accepted these Terms & Conditions in full.
